THE IMPLEMENTING RULES AND REGULATIONS OF THE NATIONAL ACADEMY OF SPORTS ACT

Pursuant to Section 22 of Republic Act (RA) No. 11470 entitled "An Act Creating and Establishing National Academy of Sports and Providing Funds Therefor", the Department of Education (DepEd) and the Philippine Sports Commission (PSC) hereby issue the following rules and regulations and are hereby promulgated to implement the provisions of the foregoing Act.

RULE I

TITLE, SCOPE AND COVERAGE AND DECLARATION OF PRINCIPLES

Section 1. Short Title. - These rules and regulations shall be referred to as the "Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 11470, otherwise known as The National Academy of Sports."

SEC 2. Scope and Coverage. - The provisions of this IRR shall apply to the creation, operation, management, and administration of the National Academy of Sports (NAS) System. The NAS System shall consist of the main campus to be established in New Clark City, Municipality of Capas, Province of Tarlac, all other future satellite branches, regional nationally-funded high schools for sports, extension campuses, and other existing locally funded high schools for sports by virtue of a memorandum of agreement between the main campus and such locally funded high schools for sports and/or the appropriate LGUs, as provided under Section 19 of the Act.

SEC. 3. Declaration of Principles. - It is the policy of the state to protect and promote the right of the citizens to quality education at all levels and undertake the appropriate steps to make education accessible to all. The State also recognizes the vital role of the youth in national building and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being.

Towards this end. the State shall establish a national sports program which shall promote physical education and encourage sports programs, intramurals, league competition and amateur sports including training for international competitions; foster self-discipline, teamwork, and excellence for the development of a healthy and alert citizenry; and develop athletes with a strong sense of patriotism and love of country.

It shall be declared a policy of the State to institutionalize an education system within the framework of the national sustainable sports program and provide training to produce world class athletes. Such a system shall ensure that measures are in place for the admission of qualified students from all sectors, including indigenous peoples, persons with disabilities, and other marginalized groups.

RULE II

DEFINITION OF TERMS

SEC. 4. Definition of Terms. - For purposes of this IRR, the terms and phrases used shall mean or be understood as follows:

(a) Act refers to RA No. 11470 entitled "An Act Creating and Establishing National Academy of Sports and Providing Funds Therefor", otherwise known as "The National Academy of Sports".

(b) Considerable potential in sports refers to the capability of a student who meets the qualification standards set by the BOT for admission.

(c) Indigenous Peoples refers to a group of people or homogeneous societies identified by self-ascription and ascription by others, who have continuously lived as organized community on communally bounded and defined territory, and who have, under claims of ownership since time immemorial, occupied, possessed and utilized such territories, sharing common bonds of language, customs, traditions and other distinctive cultural traits, or who have, through resistance to political, social and cultural inroads of colonization, non-indigenous religions and cultures, became historically differentiated from the majority of Filipinos. ICCs/IPs shall likewise include peoples who are regarded as indigenous on account of their descent from the populations which inhabited the country, at the time of inroads of non-indigenous religions and cultures, or the establishment of present state boundaries, who retain some or all of their own social, economic, cultural and political institutions, but who may have been displaced from their traditional domains or who may have resettled outside their ancestral domains.

(d) Marginalized sectors refers to those who belong to or are children of the basic, disadvantaged, or vulnerable persons or groups, as defined under Section 4(d) RA No. 9710 (Magna Carta of Women), who are mostly living in poverty and have little or no access to land and other resources, basic social and economic services such as health care, education, water and sanitation, employment and livelihood opportunities, housing, social security, physical infrastructure, and the justice system.

Marginalized sectors shall also refer to those who are belong to or are children of some of the disadvantaged sectors identified under Sec. 3(b) of RA No. 8425 (Social Reform and Poverty Alleviation Act) which includes, among others, the following: farmer-peasant, artisanal fisherfolk, workers in the informal sector, indigenous peoples, and cultural communities, differently-abled persons, victims of calamities and disasters, and urban poor.

For purposes of this IRR, marginalized sectors shall also include those who belong to or are children of self-employed or those working in family workshops, jeepney drivers, foreign domestic migrant workers, and minimum wage earners in the formal sector.

(e) NAS refers to the National Academy of Sports created and established through Republic Act No. 11470.

(f) National Academy of Sports System refers to the organization of future regional nationally funded high schools for sports integrated into one system of governance and management. Consistent with Section 19 of this Act, the BOT shall also provide for policies to enter into a memorandum of agreement with existing locally funded high schools for sports for consideration as extension campuses or branches of the NAS System. The main campus of the NAS System shall be established at the existing New Clark City Sports Complex, Capas, Tarlac.

(g) National Sports Program refers to the comprehensive sports development program of the State. It shall include, among others, the country's grassroots community sports program, school's sports program from basic education to tertiary level education, amateur and professional sports program. The National Sports Program shall guide the development of the special curriculum on sports to be implemented under the NAS System.

(h) Natural-born citizens shall the following:

* Those who are citizens of the Philippine from birth without having to perform any act to acquire or perfect their Philippine citizenship as defined under Section, Article IV of the Constitution.

* A former Filipino citizen by birth who are naturalized in another country but re-acquire his/her Philippine citizenship based on Section 4 (Derivative Citizenship) of RA 9225, otherwise known as the "Citizenship Retention and Re-acquisition Act of 2003.

(i) Persons with disabilities are those suffering from restriction or different abilities, as a result of a mental, physical or sensory impairment, to perform an activity in the manner or within the range considered normal for a human being as defined by RA No. 7277 or the "Magna Carta for Disabled persons".

(j) Special Curriculum on Sports refers to an organized set of sports content or course of study that complements the core curriculum of secondary level designed to develop potentials for athletic scholars to become learned, highly competitive and world-class athletes, and ready to pursue their chosen profession or career.

(k) Scholarship refers to the benefits, incentives award, grant, subsidy, allowances, stipends, reward, fees, or emoluments given to students who meet the criteria, and fulfill the obligations of a bonafide scholar under the NAS System.

RULE III

CREATION AND PURPOSE OF THE NATIONAL ACADEMY OF SPORTS

SEC. 5. Creation and Establishment of the National Academy of Sports System. - It is hereby created and established a National Academy of Sports System (NAS System) to develop the athletic skills and talents of students in world class sports facilities which are at par with international standards.

The NAS System is hereby mandated to implement a quality and enhanced secondary education program, integrated with a special curriculum on sports.

It shall be geared to the early recognition and development of highly talented and exceptionally gifted students and those who have demonstrated the potential of excelling in the field of sports.

The NAS System shall be attached to the DepEd, in close coordination with the PSC.

SEC. 6. Purposes of the NAS System. - Consistent with Section 4 of the Act, the purposes of the NAS System are the following:

(a) To offer, on a full scholarship basis, secondary education to natural-born Filipino citizens with considerable potential in sports;

(b) To design a special curriculum on sports taking into consideration the education and special training needs of the scholar;

(c) To implement an integrated system of governance and management in all of the campuses under the NAS System;

(d) To ensure uniformity in quality standards and systematize operations of schools under the NAS System, and rationalize the establishment of sports high schools under the NAS System in relation to Section 8 (a) of the Act;

(e) To provide a holistic quality education to enable the scholars to excel in their respective sports and likewise pursue their chosen profession or career;

(f) To provide world-class sports facilities at par with international standards for the training development programs of the scholars;

(g) To expand the NAS System, through the integration of identified sports academies and/or the creation of new sports academies; and

(h) to search for competent, exceptional, notable and talented scholars.cralawred

RULE IV

CONSTRUCTION, SITE AND USE OF THE NATIONAL ACADEMY OF SPORTS MAIN CAMPUS

SEC. 7. Construction and Site of the NAS Main Campus. - After a period of planning not exceeding one (1) year upon the effectivity of the Act, the main campus of the NAS System shall be established at the existing New Clark City Sports Complex, Capas, Tarlac, and shall be equipped with the necessary sports facilities, housing, and other amenities according to current international standards. School buildings with sufficient number of classrooms and facilities shall be constructed at the complex.

The Bases Conversion and Development Authority (BCDA) shall provide the land for the site by way of usufruct in perpetuity, subject to its utilization as provided for in the preceding paragraph.

The BCDA shall be in charge of the construction of classrooms, dormitories, and other sports facilities, and related amenities as may be determined by the BOT at the New Clark City campus.

The NAS System shall at all times be given utmost priority in the use of these existing sports facilities, dormitories, and infrastructure which shall be free of charge as long as utilized to carry out the purposes and functions of the NAS System, without prejudice to national and international sports events which will be hosted in the New Clark City and coordinated with the NAS System management.

For purposes of this IRR, the following shall be observed in the development of the NAS Main Campus:

1. The BOT shall review and approve the NAS System Main Campus Site Development. The Office of the Executive Director shall recommend a Design Plan. The Design Plan shall be in accordance with the existing laws, rules and regulations for school sites development, and for sports facilities be compliant with the international standards and technical specifications set forth by the international federation of the specific sports that will use the facility.

2. The Executive Director, after a period of planning and formulation of the NAS System Main Campus Site Development Plan, shall coordinate with the BCDA on the construction of the state-of-the-art infrastructure and world class sports facilities at par with international standards and other related amenities as may be determined by the BOT.

3. The BCDA shall provide the land for the site by way of usufruct in perpetuity, subject to its intended utilization.

4. The NAS System shall manage, operate and maintain the NAS Main Campus and all satellite campuses that may be established in the future.

5. The NAS System shall at all times be given utmost priority in the use of the existing sports facilities, dormitories, and infrastructure which shall be free of charge as long as utilized to carry out the purposes and functions of the NAS System, without prejudice to the national and international sports events which will be hosted in the New Clark City and coordinated with the NAS System management.

6. Implementing rules and guidelines on the use of NAS facilities shall be issued for guidance.

RULE V

GOVERNANCE OF THE NATIONAL ACADEMY OF SPORTS SYSTEM

SEC. 8. Board of Trustees. - The NAS System shall be governed by a Board of Trustees hereinafter referred to a "BOT".

1. The BOT shall be composed of the following:

(a) Secretary of the Department of Education as the Chairperson;

(b) Chairperson of the Philippine Sports Commission as Vice Chairperson;

(c) Executive Director of the NAS System as member;

(d) President of the Philippine Olympic Committee as member;

(e) Chairperson of Commission on Higher Education (CHED) as member; and

(f) Two representatives from private sectors as members.cralawred

2. Qualifications of the Two (2) Private Sector Representatives: The representatives from private sector shall be known experts in the field of sports, education or both, and shall be elected by the BOT. They shall be appointed for a term of two (2) years, renewable for another two (2) years, without reappointment.

SEC. 9. Powers and Functions of the Board. - The exercise of the powers of the NAS System is hereby vested exclusively in the BOT. The BOT shall have the following specific powers and duties, in addition to its general powers of administration and the exercise of all the powers granted to the board of directors of a corporation under Section 25 of Republic Act No. 11232, otherwise known as the "Revised Corporation Code of the Philippines", as may be applicable:

(a) To formulate policies, guidelines and criteria in order to rationalize the establishment, administration and operation of the sports high schools under the NAS System in accordance with a national sports program;

(b) To identify the satellite branches and regional campuses of the NAS System for the later expansion after the establishment of the main campus of the NAS System as provided in Section 5 hereof;

(c) To approve the curricula, course of study, and rules of discipline drawn up by the Executive Committee as hereinafter provided. The curriculum shall be designed to address the specific training needs of a student-athlete while delivering a holistic and quality education;

(d) To formulate policies on personnel organization, appointment, promotion, retention or renewal of contracts compensation, removal for just cause, rewards, incentives, and other conditions of employment for administrators, faculty, and staff of the NAS System;

(e) To approve appointments made and contracts entered into by the Executive Director in connection with the employment of administrative officers, teachers, lecturers, and other employees of the school;

(f) To determine the conditions of the acceptance of paying students for special programs and trainings, such as sports camps and clinics, and establish the qualifications and criteria thereof;

(g) To provide and approve fellowships and trainings for administrators, faculty members, and staff;

(h) To approve the grant of scholarships, stipends, and such other allowances to deserving students based on the guidelines and implementing rules and regulations of the Act;

(i) to establish the criteria for the selection and admission of students which shall include, among others, national competitive trials and examinations;

(j) To recruit the best student-athletes from the different regions of the Philippines to be enrolled in the NAS System to better hone their skills and talents;

(k) To develop the athletic potential of every student together with a sound and strong academic base;

(l) To provide a training program for students with the end goal of producing athletes who can compete in international competitions;

(m) To approve the issuance of certificates or diplomas to successful candidates for graduation;

(n) To receive and appropriate for the ends herein specified such sums as may be provided by law for the support of the NAS System;

(o) To receive, in trust, legacies, gifts, and donations of real and personal properties of all kinds and to administer the same for the benefit of the NAS System or for aid to any of its students;

(p) To enact rules and regulations, not contrary to law, as may be necessary to carry out the purpose and functions of the NAS System, including, but not limited to, Operations Manuals and Students Handbook and Code of Conduct;

(q) To perform any and all other acts incident to or required by virtue of its creation.

For purposes of this IRR, the BOT shall also have the powers and functions to promote and support research and development initiatives on emerging technologies and current trends on sports and athlete management, and to foster partnerships and exchange programs with foreign schools, international sports academies and sporting organizations.

In addition to the aforementioned functions, provisions under Section 35 of RA 11232, known as the "Revised Corporation Code of the Philippines", applicable to the NAS Charter and this RR shall be part of the powers and functions of the BOT.

SEC. 10. Hiring of Foreign Coaches, Trainers, and Consultants, - In addition to the powers and functions vested to the BOT under Section 8 of the Act and Section 9 of this IRR, the BOT shall be allowed to approve the hiring of licensed foreign coaches, trainers, and consultants: Provided, that the PSC shall certify as to the necessity of hiring such coaches, trainers, and consultants, including a justification that their competence and skills are not locally available or proven to be incomparable with their local counterparts.

The BOT shall provide guidelines and mechanisms to ensure that the new knowledge and training methods introduced by foreign coaches, trainers, and consultants shall be passed on the student athletes and local coaches, trainers and consultants of the NAS System.

The qualifications, skills, and compensation of the licensed foreign coaches, trainers and consultants shall be determined by the BOT, in close coordination with the PSW and the POC.

SEC. 11. Meetings of the Board. - The BOT shall regularly convene at least once every quarter of the NAS System school calendar.

The Chairperson of the BOT may call a special meeting whenever necessary: Provided, that members are notified in writing at least three (3) calendar days before said meeting.

A majority of all members holding office at the rime the meeting is called shall constitute a quorum for BOT meetings. Provided, that the Chairperson and the Vice-Chairperson of the BOT are among those present in the meeting. In the absence of the Chairperson, an Undersecretary of the DepEd shall be duly designated by the Chairperson as alternate to sit on the meeting.

All members who are not receiving regular compensation from the government shall receive reasonable per diem to be determined by the BOT for every meeting of the BOT, subject to existing rules and regulations observed by the boards of similar specialized institutions.

For purposes of this IRR, official representatives of the BOT shall be allowed during meetings provided that:

(a) Representative is a next lower in rank official; and

(b) Representative is the current POC Secretary-General.

No representatives shall be allowed for NAS board members from the private sector.

Designation of official representative must be in writing and shall be submitted to the NAS Board Secretariat at least three (3) days before the scheduled meeting.

SEC. 12. Reporting Requirements and Auditing of Accounts. - The BOT shall submit to the Commission on Audit (COA), Department of Budget and Management (DBM), and Congress a detailed report on the progress, condition, and needs of the NAS System containing, among others, the financial statements, statement of assets and liabilities, other revenue sources and program for expenditures, physical and financial accountability reports, and other similar reportorial requirements on or before the fourteenth (14th) day of February of each year. All accounts and expenses of the NAS System shall be audited by the COA or its duly authorized representative.

RULE VI

MANAGEMENT AND GOVERNANCE THE NATIONAL ACADEMY OF SPORTS SYSTEM

SEC. 13. Executive Director of the NAS System. - The NAS System shall be headed by an Executive Director who shall serve for a period of five (5) years. The Executive Director shall be elected by the members of the BOT, based on the guidelines and qualifications set forth in this IRR, preferably with a Master's degree in the field of sports education, sports science, education, management, and substantial experience in managing an education institution.

The BOT shall likewise fix the compensation of the Executive Director subject to existing Compensation and Position Classification System.

The Executive Director shall be responsible for the administration and operation of the NAS System, and shall coordinate the implementation of policies and guidelines set by the BOT, in addition to those specifically provided for in this IRR.

For purposes of this IRR, the Executive Director shall have the rank of a Director similar to the head of a Bureau/Service of the DepEd, unless otherwise provided by the BOT consistent with paragraph 2 of this Section in relation to Section 6 of the Act. The Executive Director shall exercise administrative supervision over all the Campus Directors under the NAS System and shall be the primary implementer of policies and guidelines set by the BOT. As a member of the BOT, the Executive Director shall articulate to the BOT the priority concerns of all campuses.

1. Creation of the Search Committee for the Selection of the Executive Director of the NAS System. Consistent with Section 6 of the Act, a Search Committee is hereby created to assist the BOT in the election of the Executive Director of the NAS System, subject to the following guidelines:

(a) The composition of the Search Committee shall be determined by the BOT;

(b) The Search Committee shall call for submission of application for the position of the Executive Director upon the effectivity of the vacancy of the position;

(c) The Search Committee shall then perform screening that shall include, but not limited to, paper screening, interviews and other processes that will determine the merit and fitness of the candidate;

(d) The Search Committee shall assist the BOT in the evaluation and assessment of candidates based on the guidelines developed, and the qualifications stipulated in Section 13.2 of this IRR;

(e) The Search Committee shall draft the criteria, with the approval of the BOT, in the evaluation and assessment of candidates;

(f) The Search Committee shall determine the mental and physical fitness of the candidate;

(g) The Search Committee shall then present to the BOT the results of the evaluation and assessment of the candidates;

(h) The Search Committee shall then present the shortlisted candidates and upon the option of the BOT, may be presented for interview by the members of the BOT; and

(i) BOT shall then elect among the shortlisted candidates the Executive Director.cralawred

2. Qualification Requirements

(a) Educational Attainment: A holder of at least Master's Degree in the field of sports education, sports science, education, management, health, or other related field; and

(b) Experience

(b.1) At least 7 years administration and management experience in an educational institution;

(b.2) At least 7 years of teaching experiences in the field of Physical Education or sports; and

(b.3) Al least 5 years of sports/health management, policy formulation, or program and project development.cralawred

3. Duties and Functions of the Executive Director. The NAS System Executive Director shall have the following duties and functions:

(a) Responsible for the administration and day-to-day operation of the NAS System;

(b) Manage and administer the day-to-day operation of the NAS System;

(c) Implement policies and guidelines set by the BOT;

(d) Sit as a member of the BOT;

(e) Recommend to the BOT policies on matters pertinent to the efficient and effective operation of the NAS System; and

(f) Such tasks and functions that may be determined and assigned by the BOT.cralawred

4. Vacancy. Should a vacancy occur during the tenure of the incumbent Executive Director due to death, permanent disability, removal from office, suspension, resignation or any other reason, the BOT shall elect a new Executive Director who shall serve a new 5-year term.

SEC. 14. Executive Committee. - There shall be an Executive Committee consisting of the Executive Director, the Deputy Executive Director, as created in Section 13 of the Act, the heads of departments of the NAS System, and such other ranking faculty members or officials of the NAS System, as may be determined by the BOT.

The Committee shall have the power to screen and select students for admission and the recipients of scholarships, stipends, and other allowances as well as to develop the curricula, course of study, and rules of discipline. It shall be responsible for the development of the athletic potential of students by providing training programs to train athletes who can compete in international competitions. It shall also implement and execute policies laid down by the BOT and exercise such other functions, powers and duties as the BOY may prescribe.

For purposes of this IRR, the Committee shall also develop and submit to the BOT for approval, an organizational structure of the NAS System and the prospective structure, likewise, of a NAS Campus.

The composition of the Committee, with their respective designations, shall be as follows:

(a) Executive Director as Chairperson;

(b) Deputy Executive Director as Vice-Chairperson;

(c) Heads of the respective Departments under the NAS organizational structure; and

(d) Ranking faculty members or officials of the NAS System as maybe recommended by the Executive Director and approved by the BOT.

The Heads referred to to in Item (c) and the faculty cited in Item (d) shall be dependent on the number of Department Offices to be created under the NAS Organizational Structure approved by the BOT.

SEC. 15. Functions of the Executive Committee. - The functions of the Executive Committee are as follows:

(a) Develop screening and selection guidelines for admission of students;

(b) Shall have the power to scree and select students for admission and the recipients of scholarships, stipends and other allowances;

(c) Review the program standards, curricula, course of study, and rules of discipline;

(d) Responsible for the development of the athletic potential of scholars by providing training programs to train athletes who can compete in international competition;

(e) Execute and implement policies laid down by the BOT;

(f) Develop and submit to the BOT for approval an Organizational Structure of the NAS System and the prospective structure, likewise, of a NAS Campus; and

(g) Exercise such other functions, powers and duties as the BOT may prescribe.

SEC. 16. Deputy Executive Director of the NAS System. - There shall be a Deputy Executive Director who shall assist the Executive Director. In the absence of the Executive Director, the Deputy Executive Director shall assume the administrative and supervisory functions of the Executive Director.

The Deputy Executive Director, whose compensation shall be fixed by the BOT, shall be appointed by the Chairperson of the Board, subject to the approval of the members of the BOT and to existing Compensation and Position Classification System.

The qualification and eligibility requirement are:

(a) Educational attainment: Holder of at least a Master's Degree in the field of sports education, sports science, education, management, and other related field;

(b) Experience:

(b.1) At least four (4) years experience in managing an education institution;

(b.2) At least 5 years of teaching experiences in the field of Physical Education or sports; and

(b.3) At least 5 years of policy formulation, program and project development and management.cralawred

(c) Eligibility: Career Service Executive Eligibility (CSEE) or Career Executive Service Eligibility (CESE); and

(d) Training: 120 hours of relevant training.

SEC. 17. Registrar of the NAS System. - There shall be a Registrar of the NAS System who shall act as the Board Secretary and keep all records of the NAS System.

The Registrar shall be appointed by the Executive Director, with the approval of the BOT. The Registrar shall have the rank of Division Chief and shall have the following qualification.

For purposes of this IRR, the Registrar, whose rank shall be equivalent to Division Chief of the DepEd, unless otherwise provided by the BOT in relation to Section 8(d) of the Act, must meet the following qualifications and eligibility requirements:

(a) Education: Master's Degree preferably in management, or other related field;

(b) Experience: At least seven (7) years relevant experience;

(c) Eligibility: Career Service Professional; and

(d) Training: 40 hours relevant training.

SEC. 18. Treasurer of the NAS System. - There shall be a Treasurer of the NAS System who shall keep custody of the its funds and properties.

The Treasurer shall be appointed by the Executive Director, with the approval of the BOT.

All accounts and expenses of the NAS System shall be audited by the COA or its duly authorized representative.

For purposes of this IRR, the Treasurer, whose rank shall be equivalent to Division Chief of the DepEd, unless otherwise provided by the BOT in relation to Section 8(d) of the Act, must meet the following qualifications and eligibility requirements:

(a) Education: Master's degree in accountancy, financial management or related fields;

(b) Experience: at least four (4) years of relevant experience;

(c) Eligibility: Career Service Professional; and

(d) Training: 40 hours relevant training.

The Treasurer by the authority of the BOT, shall open and maintain a Trust Fund account of the NAS System.

SEC. 19. Personnel of the NAS System. - The Executive Director shall, upon approval of the BOT, employ professional and highly skilled managers, educators, teachers, coaches, trainers, sports and medical professionals, who are experts in the field, and other personnel with long and vast experience in sports education and administration to ensure the proper operation and maintenance of the NAS System, subject to existing Compensation and Position Classification System.

Officers or employees of the government engaged as lecturers in the NAS System may receive compensation in addition to their salary at a rate to be fixed by the BOT subject to existing rules and regulations: Provided, that their duties as lecturers are performed outside of regular office hours.

RULE VII

SATELLITE BRANCHES AND REGIONAL CAMPUS
OF THE NATIONAL ACADEMY OF SPORTS SYSTEM

SEC. 20. Campuses. - The BOT shall provide for policies for the organization of future regional nationally-funded high schools for sports. The BOT shall also provide for policies to enter into a memorandum of agreement with existing locally funded high schools for sports for consideration as extension campuses or branches of the NAS System. The extension campuses shall be organized in coordination with the concerned local government unit, the DepEd, and the PSC, and in consultation with the�DBM.

For purposes of this IRR, the following provisions shall establish the governance structure of the campuses under the NAS System:

1. Administration of Campuses. The BOT shall formulate and develop policies and guidelines on the establishment and operation of these satellite branches and regional campuses. The organizational structure of these extended campuses shall be approved by the BOT.

2. Campus Director. A campus shall be headed by a Campus Director with a rank equivalent to a Schools Division Superintendent of the Department of Education. The Campus Director shall be appointed by the Chairperson of the BOT upon the recommendation of the Executive Director and subject to the approval of the Members of the BOT.

For purposes of this IRR, qualifications of the Campus Director shall be as follows:

(a) Education: At least a Master's Degree in related field, preferably in educational administration, sports or health management;

(b) Experience: At least three (3) years in an administration and management in an educational institution;

(c) Eligibility: Career Service Executive Eligibility (CSEE) or Career Executive Service Eligibility (CESE); and

(d) Training: 120 hours relevant training.cralawred

3. Organization of Future Regional Nationally Funded High Schools for Sports under the NAS System and Inclusion of Existing Locally Funded High Schools for Sports as Extension Campuses or Branches of the NAS System.

3.1. Satellite Branches and Regional Campuses. After the establishment of the Main Campus, the BOT shall:

(a) Identify the satellite future regional nationally funded high school for sports and provide for policies for the organization of such school for sports;

(b) Provide for policies to enter into a memorandum of agreement with existing�locally funded high school for sports for consideration as extension campuses or branches of the NAS System;

(c) Coordinate with the concerned local government unit, the DepEd, the PSC, and in consultation with the DBM for the organization of the extension campuses; and

(d) Approve the organizational structure of these campuses.cralawred

RULE VIII

CURRICULUM OF THE NATIONAL ACADEMY OF SPORTS SYSTEM

SEC. 21. Curriculum of the NAS System. - Pursuant to Section 4, Section 8(c), and Section 12, paragraph 2 of the Act, the Executive Director upon direction from the BOT, shall immediately convene the Executive Committee and plan for the development of the curriculum of NAS System. To ensure compliance with the requirements of the Enhanced Basic Education Curriculum as mandated under RA 10533 (The Enhanced Basic Education Act of 2013).

The Executive Director, as Chairperson of the Executive Committee, may create various sub-committees in order to assist the Executive Committee and expedite the development of the curriculum. The primary function of the Committee is to develop a specially designed secondary curriculum integrated with sports related subjects.

The NAS System curriculum shall:

(a) Maintain the core subjects and complement the special subjects in sports or allied courses prescribed in RA 10533;

(b) Align with the National Sports Program Framework; and

(c) Contain development athletic training programs for students specific to his/her chosen sports;

For purposes of this IRR and with reference to the implementation of the curriculum, the following shall be taken into consideration:

(d) Learning delivery modalities for athletic scholars;

(e) Time allocation for aforementioned athletic training program; and

(f) Learning resources.

SEC. 22. Special Committee on Curriculum Development. - The NAS System, through the Executive Director, shall invite experts from different�agencies or institutions such as, but not limited to, DepEd, PSC, and CHED, Philippine Olympic Committee (POC), and representatives from the academe and the private sector to compose the Special Committee on Curriculum Development.

The Executive Director shall serve as the Chairperson of this Special Committee on Curriculum Development, and may designate additional members of the committee, and/or create sub committees as he may deem necessary.

The Special Committee on Curriculum Development shall perform the following functions:

(a) Develop the curriculum of the NAS System;

(b) Consult with other stakeholders on the development of the curriculum; and

(c) Perform other relevant tasks as may be assigned by the BOT or the Executive Committee.

The Special Committee on Curriculum Development, upon its creation, is given three (3) months to formulate the NAS System curriculum for the review of the proper DepEd office in charge of curriculum, prior to its submission to the BOT for approval.

The curriculum shall be reviewed and evaluated every five (5) years or upon the recommendation of the Executive Committee, in coordination with the approval of the BOT.

RULE IX

ADMISSIONS OF THE NATIONAL ACADEMY OF SPORTS SYSTEM

SEC. 23. Requirements for Admission. - The NAS System is a secondary school that is open to all qualified students from all sectors of the society including indigenous marginalize groups, natural born Filipino citizens, and who possess considerable potential talent in sports.

SEC. 24. Admission. - The Executive Committee with the approval of the BOT shall develop a manual of procedures for admission. The manual shall include, among others, the requirements, qualifications and disqualifications of applicants.

The athletic scholar shall be bound by the obligations set forth in the contract as a requirement for admission.

RULE X

SCHOLARSHIP OF THE NATIONAL ACADEMY OF SPORTS SYSTEM

SEC. 25. Scholarship. - The benefits and incentives of the athletic scholars shall be determined by the BOT such as, but not limited to:

(a) Free accommodation. Dormitories shall be constructed to house athletic scholars, free of charge;

(b) Provision of food as supervised by a licensed nutritionist;

(c) Provision of stipends;

(d) Free use of sports facilities for training. BCDA shall give priority to NAS athletic scholars;

(e) Free training and competition uniform;

(f) Provision for sports equipment; and

(g) Provision for health, emergency and rehabilitation support systems (insurance, clinics, etc.)

RULE XI

TAXES, DUTIES AND TAX EXEMPTIONS

SEC. 26. Payment of National Taxes and Customs Duties. - The payment of national taxes, including customs duties, of the NAS System shall be charged against the Tax Expenditures Fund (TEF) provided for in the annual General Appropriations Act.

The NAS System shall be exempt from withholding taxes on the honoraria or fees paid by the NAS System to visiting lecturers or professors from abroad, subject and pursuant to existing Philippine tax treaties.

SEC. 27. Tax Deduction and Exemption of Donations and Contributions. - All grants, legacies, bequests or devises, gifts and donations for the benefit of the NAS System, its support and/or maintenance, or for aid to any of its students shall be tax-exempt and fully deductible from the gross income of donors in accordance with the National Internal Revenue Code (NIRC) of 1997, as amended.

RULE XII

FINAL PROVISIONS

SEC. 28. Transitory Provisions. - During the initial implementation of the Act when no other campus is established yet, the NAS System Executive Director shall function as Campus Director of the NAS Main Campus. As new campuses are organized to comprise the NAS System with each headed by a Campus Director, the Executive Director shall turn over the Main Campus to the newly-designated Campus Director and assume the administrative and supervisory functions over the NAS System.

SEC. 29. Joint Congressional Oversight Committee on the NAS System. - The Joint Congressional Oversight Committee created under Section 20 of the Act shall be composed of (5) members each from the Senate and the House of Representatives, including the Chairpersons of the Committees on Basic Education, Arts and Culture in the Senate and Basic Education and Culture in the House of Representatives, Youth and Sports Development, and Finance in the Senate and Appropriations in the House of Representatives. The membership of the Committee for each House shall have at least one (1) minority member.

SEC. 30. Appropriations. - The Secretary of the DepEd shall immediately include in the Department's budget the amount necessary for the effective implementation of the Act which shall be included in the annual General Appropriations Act.

Upon the effectivity of the Act, the BCDA shall likewise immediately include in its procurement plan the construction of classrooms, dormitories, and other sports facilities and related amenities for the NAS main campus whose funding shall also be included in the annual General Appropriations Act.

SEC. 31. Separability Clause. - If any part or provision of this IRR is declared unconstitutional or invalid, the remainder of this IRR or any provision not affected thereby shall remain to be in full force and effect

SEC. 32. Repealing Clause. - All other DepEd orders, memoranda, and other issuances or parts thereof which are inconsistent with the provisions of this IRR are hereby modified, superseded. or repealed accordingly.

SEC. 30. Effectivity. - This IRR shall take effect immediately upon its approval and its publication in the Official Gazette or in a newspaper of general circulation.
