REPUBLIC ACT NO. 4142 - AN ACT TO
STANDARDIZE THE SALARIES OF PROVINCIAL AND CITY FISCALS AND THEIR
ASSISTANTS, AND APPROPRIATING FUNDS FOR THE PURPOSE

Section
1. Regardless of the class or category of provinces
and cities, the annual salaries of provincial and city fiscals and
their assistants shall be as herein below fixed: For provincial and
city fiscals, fifteen thousand pesos; for the first assistant
provincial and city fiscals, eleven thousand four hundred pesos; for
the second assistant provincial and city fiscals, ten thousand eight
hundred pesos; for the third assistant provincial and city fiscals,
nine thousand six hundred pesos; for the fourth assistant provincial
and city fiscals, eight thousand four hundred pesos for the fifth
assistant provincial and city fiscals, seven thousand two hundred
pesos. Sec. 2. The provincial and city fiscals and their assistants, whose appointments have already been confirmed by the Commission on Appointments prior to the approval of this Act, shall automatically be entitled to the benefits of this Act: provided, that no provincial or city fiscal and their assistants shall suffer any diminution in rank or salary by virtue of the provision of this Act: provided, further, that in case of vacancy in any grade or rank of assistant fiscals in the provinces and cities caused by the promotion, death, resignation, retirement, transfer, dismissal or other just causes, the assistant fiscals of the lower ranks or grades shall, based upon their efficiency and performance ratings, experience, integrity and seniority in the service, have preferential right of promotion to such vacant position upon recommendation of the provincial or city fiscal or the chief prosecuting attorneys of the Department of Justice. Sec. 3. The sum of nine hundred thousand pesos or so much thereof as may be necessary is hereby appropriated out of any funds in the National Treasury not otherwise appropriated, for the salary increases provided for in this Act for the fiscal year nineteen hundred sixty-five. Such sums as may be necessary in subsequent years shall be included in the annual General Appropriations Act. Sec. 4. This Act shall not apply to the City of Manila and Quezon City. Sec. 5. All laws or parts thereof which are inconsistent with the provisions of this Act are hereby repealed. Sec. 6. This Act shall take effect upon its approval. Approved: June 20, 1964 |
